Lush & Wild Flowers — Terms & Conditions (Aligned with Contract)

1. Overview

Welcome to Lush & Wild Flowers. By accessing our website or working with us, you agree to the following Terms & Conditions.

These terms apply to general use of our website and services. Full service details, including pricing, timelines, and responsibilities, will be outlined in your individual contract.

2. Services

Lush & Wild Flowers provides custom floral design for weddings, events, and other occasions.

All services are customized and confirmed through a proposal, invoice, or contract. Any additional items or changes must be agreed to in writing.

3. Inquiries & Booking

Submitting an inquiry does not guarantee booking.

To secure your date, you must:

  • Approve your proposal

  • Sign a contract (if applicable)

  • Pay a non-refundable retainer

Dates are reserved on a first-come, first-served basis.

4. Payments

  • Payment schedules will be outlined in your invoice or contract

  • A non-refundable retainer is required to secure your date

  • Final payment must be completed by the due date provided

Failure to complete payment may result in cancellation of services.

5. Cancellations & Refunds

  • All retainers are non-refundable

  • Additional payments may also be non-refundable depending on timing and work completed

  • Clients may remain responsible for outstanding balances unless otherwise agreed

6. Floral Availability & Substitutions

Due to the nature of fresh flowers:

  • Specific varieties, colors, and blooms cannot be guaranteed

  • Substitutions may be made with flowers of equal or greater value

  • Overall design, aesthetic, and color palette will always be honored

7. Price Adjustments

Floral pricing is subject to market conditions.

Lush & Wild Flowers reserves the right to adjust pricing by up to 15%. Any adjustments will be communicated prior to final payment.

8. Final Changes

All final design decisions and quantities must be confirmed at least 30 days prior to the event.

No major changes can be made after this time.

9. Delivery, Setup & Access

We will coordinate delivery and setup within an agreed window.

Clients are responsible for ensuring:

  • Venue access

  • Setup space

  • Necessary permissions

  • Accurate venue contact information

We are not responsible for delays caused by venue restrictions or lack of access.

10. Responsibility After Delivery

Once florals are delivered and set up, Lush & Wild Flowers is not responsible for damage caused by:

  • Weather conditions

  • Guests or venue staff

  • Movement or relocation of arrangements

  • General wear of perishable products

11. Rentals

Any rental items (vases, structures, candles, etc.) remain the property of Lush & Wild Flowers.

Clients agree to:

  • Return rentals in original condition, or

  • Allow scheduled pickup

Lost or damaged items will incur replacement fees.

12. Artistic Style

By booking Lush & Wild Flowers, you acknowledge:

  • Our work is natural, organic, and design-forward

  • We maintain creative control to ensure a cohesive final product

  • Final designs may vary slightly from inspiration photos

Dissatisfaction based solely on artistic interpretation is not grounds for refund.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Liability is limited to the total amount paid for services

  • We are not responsible for allergic reactions, insect activity, weather impacts, or third-party actions

14. Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to:

  • Natural disasters

  • Venue closures

  • Government restrictions

  • Emergencies or severe illness

15. Website Use & Intellectual Property

All website content—including images, designs, and branding—is the property of Lush & Wild Flowers.

You may not copy, reproduce, or use content without written permission.

16. Third-Party Services

We may use third-party platforms (such as payment processors). We are not responsible for their practices or policies.

17. Governing Law

These Terms are governed by the laws of the State of Colorado.

18. Updates

We may update these Terms & Conditions at any time. The most current version will always be available on our website.
